At its session on 11 December 2006, pursuant to Articles 15 and 16 of the Order on Core Library Services (OG RS No. 29/03), the Library Council adopted the following:
RULES ON THE GENERAL TERMS AND CONDITIONS FOR THE OPERATION OF THE JOŽE UDOVIČ PUBLIC LIBRARY, CERKNICA
I. INTRODUCTORY PROVISIONS
Article 1
These Rules on the General Terms and Conditions (hereafter: Rules) for the operation of the Jože Udovič Public Library, Cerknica (hereinafter: Library) define the following: business ethics, the Library’s obligations to its users and members, the users’ and members’ rights and duties regarding the use of the Library and its services, the Library’s availability and the terms of use, the loan periods and other restrictions related to lending various materials, services and Library use, the working language, the types of service and a service price list.
Article 2
The central public library in Cerknica has offices at Stari trg and Nova vas. The Library features materials for both young people and adults. The Library’s duty is to satisfy the information, cultural, educational and entertainment needs of its users and members.
Article 3
The Library’s aim is to provide the free flow of materials and information, but it shall not be liable for the consequences of their use.
II. BUSINESS ETHICS
Article 4
Business ethics within the framework of the Library shall be judged according to general library science standards. The Library and the members and users of its services and equipment shall be required to act in accordance with the statutory provisions on copyright and related rights, data protection, health and safety at work, rights to information and other constitutional and legislative provisions.
Article 5
The Library keeps a special drawer for complaints and commendations. Should a user or member not achieve their intended effect after submitting a complaint in this drawer, they have the possibility of filing a complaint with the Library Director and, ultimately, with the Library Council. The Library is required to provide a detailed response to the complaint in the shortest amount of time possible.
III. THE MUTUAL RIGHTS AND DUTIES OF THE LIBRARY, ITS USERS AND MEMBERS
Article 6
The Library shall perform and provide the following services:
- free access to and use of its collections;
- access to public catalogues and other databases and sources of information;
- access to and use of publicly available electronic sources related to the public authorities;
- the transmission of information on certain materials and from these materials;
- lending Library materials for use in the Library or at home;
- inter-library loans;
- member training to enable them to use Library services independently;
- help and consultation when searching for materials and information, as well as on Library use;
- familiarisation with the Library’s new features;
- copying Library-owned materials;
- making reservations for Library materials;
- access to the Internet;
- various events.
Article 7
Library members and users are required to obey the following house rules:
- when on Library premises, behave appropriately and do not hinder or disturb other Library members and users;
- handle Library materials, equipment and real estate responsibly and prudently;
- materials borrowed from the Library are not to be loaned to other persons; these materials are the responsibility of the person who originally borrowed them from the Library;
- follow the instructions in the Fire Escape Plan;
- obey the instructions of Library employees.
Article 8
The following is prohibited on the Library premises:
- smoking,
- eating or drinking,
- using mobile phones,
- pets, except for specially equipped guide dogs,
- roller or inline skates.
Article 9
Library members and users are prohibited from entering employee working areas, meaning behind counters, storage areas and other employee-only areas. Library members and users are not allowed to stay in the Library outside its working hours except during organised events.
IV. THE LIBRARY’S AVAILABILITY AND TERMS OF USE
Article 10
Library users are any natural persons who use Library materials, services, premises and equipment. Library members are users who joined the Library. Legal persons may become members as well. Users must join the Library:
- to borrow materials for use at home,
- to make reservations or place orders for Library materials,
- to order materials through the inter-library loan system,
- to use electronic databases, electronic serial publications and Web services that require user passwords.
Article 11
Any person who consents to the Library Rules and fills out and signs the Membership Application Form may become a member. Legal persons must authorise an employee who shall use the Library services with a membership card containing the name of the collective member.
Article 12
Users may become Library members by filling in the Membership Application Form and presenting a valid identity document containing a photograph, their permanent place of residence or other appropriate information in the case of legal persons. Membership Application Forms for minors must be signed by their parents or guardians. High school or college students must present their high school or college cards, their grade index or a written confirmation of enrolment. Unemployed persons must prove their status with a confirmation document from the Employment Service of Slovenia, which must not be more than a month old. Retired persons must submit a confirmation document of their retired status. Foreign citizens without a permanent place of residence in Slovenia must present a confirmation document on their temporary place of residence and a valid identity document containing a photograph. High school and college students and unemployed persons must present the stated supporting documents each time they wish to renew their membership. Members are required to notify the Library of any changes in their residential address and other data provided in the membership registration procedure as soon as possible. By signing the Membership Application Form, members undertake to use any Library materials or services in accordance with these Rules. During the membership registration procedure, the librarians are required to familiarise future members with the basic layout of the Library materials and the basic rules of Library use.
Article 13
After the completion of the membership registration procedure, members shall receive a membership card, which is proof of their membership status. Membership cards are not transferable. The Library shall not be held liable for any misuse of the membership card. Members must present their membership card in order to borrow Library materials, use the reading room or the Library computers. If there is reasonable doubt about the identity of the person presenting a membership card, librarians may request confirmation of their identity with a valid identity document containing a photograph. Any loss or theft of membership cards must be reported to the Library immediately. Until the Library receives such notification, any misuse of the membership card will be the responsibility of the member in question, despite the card no longer being in his or her possession. The missing membership card shall be erased from the records immediately on the respective member’s request, but only after all liabilities have been settled. In such cases, members shall receive a new membership card with a new record number. The costs for replacing a lost card shall be covered by the member. Members shall also cover the costs for replacing damaged or destroyed membership cards or for making a membership card containing updated identity data.
Article 14
In addition to the standard membership cards, the Library may award honorary membership cards to persons who have made a substantial contribution to the Library’s activity, development and image. The granting of honorary membership cards shall be at the Library Director’s discretion or at the proposal of Library Council members.
Article 15
Library members who prove their status with an appropriate legal document shall cover a part of the expenses incurred in the performance of Library services with an annual membership fee and other contributions, This does not include children, teenagers under 18 years of age and unemployed persons. The amount and type of contribution is evident from the Library price list annexed to these Rules. With this membership fee and other contributions, members shall cover a part of the additional expenses incurred in the performance of services.
Article 16
Library employees and retired Library employees shall pay no annual membership fees or any other expenses for Library services.
Article 17
External Library Council members and members of library science associations shall pay no annual membership fees, but they must abide by the provisions of these Rules that apply to other users and members.
Article 18
(the Library collection and catalogue)
The free Library materials are available in the sections for adults (featuring a reading room) and for young readers. It is organised in accordance with the UDC scheme (Universal Decimal Classification) and experts’ recommendations. The Library features a reference collection, a collection on Slovenia and a collection of periodicals that are normally used only in the Library. Library materials have been professionally processed and can be found in the local computer catalogue available on the library information system website (http://cobiss.izum.si). The catalogue offers bibliographical information, information on the physical availability of materials (available, loaned, reserved or ordered), location of the materials and their status (available to be borrowed for use at home, available for use on the Library premises, reserved, etc.).
V. LOAN PERIODS AND OTHER RESTRICTIONS RELATED TO LENDING VARIOUS MATERIALS, SERVICES AND LIBRARY USE
Article 19
(rules on borrowing materials for home use)
Library members may borrow Library materials to use at home only for themselves, as their membership cards are not transferable. Members are not allowed to lend borrowed materials as these are their responsibility. When borrowing or returning materials, members shall receive a printed list of all the materials they have borrowed and their return deadlines. After settling any monetary claims, the members shall receive a printed invoice. Submission of this printed list or invoice is mandatory. Members are required to verify the correctness of the printed list. Any subsequent reclamation claims shall not be processed.
Article 20
The loan period for periodicals is 14 days, 20 days for fiction and 30 days for professional literature. The loan periods for non-book materials are stated on the price list. Depending on the number of copies and demand, the loan periods for books that are a part of school curriculum and books for the Reader’s Badge award and similar are less than 20 days. Users shall set the return deadline together with the librarian. Members with one membership card may borrow a maximum of ten books and ten magazines, two copies of audio or video material and one copy of multimedia or language course material.
Article 21
In the event of a breakdown of the computerised loan system, it shall only be possible to return Library materials. Loaning shall be possible only as an exception; in such cases, only one copy of Library materials may be borrowed.
Article 22
The loan period may be extended, but only if the materials have not been reserved. As a rule, the loan period may only be extended once. This period may not be extended in the case of reserved materials, non-book materials and materials for which a written reminder has already been sent out. Members may avoid paying late fees by extending the loan period of their borrowed materials. The loan periods may be extended in the following ways:
- by visiting the Library in person,
- by telephone during working hours,
- by e-mail: info@kjuc.si,
- online, using a Library-provided personal password.
Article 23
The Library charges late fees in accordance with its price list for materials returned after the expiry of their loan period. Members shall receive the first written reminder if they do not return the materials on time. The second and third written reminders shall be sent out at intervals of 14 days. A reminder prior to filing an official complaint shall follow after 30 days. The cost of reminders is cumulative. They shall be covered by the member in question in accordance with the price list. If the member fails to do so, his or her membership rights shall be put on hold until his or her liabilities or invoices are fully settled.
Article 24
In exceptional circumstances (e.g. illness, accidents, etc.), members may be exempted from paying late fees by submitting a valid written request. The Library Director shall decide on this exemption.
Article 25
In exceptional circumstances, Library members may be allowed to settle their late fees, reminder costs and any possible compensation in several instalments. The smallest possible instalment is SIT 3,595 or EUR 15. The debt must be fully settled within 6 months of receipt of the last reminder. The Library Director shall decide on any instalment payments.
Article 26
Library members (or their authorised representatives) are responsible for the borrowed materials and for the appropriate use of Library equipment with their assets. Should they lose or damage any materials, or damage any equipment, the Library shall hold them liable for compensation. As a rule, users must replace damaged or lost materials with new copies within 6 months of borrowing the material in question at the latest. If the material cannot be replaced (bought on the market), the compensation shall be equal to the market price of the relevant material; in other cases, the compensation is set on the basis of the average price of Library materials. In addition to this compensation for lost materials, members shall be required to pay any reprocessing costs and costs of equipping in accordance with the price list.
Article 27
Library materials may be reserved or ordered in person or by telephone. Reserved or ordered materials shall be kept for 3 business days after the relevant member received a telephone or written notice of its availability or after he or she ordered it. The costs of informing shall be settled on the receipt of the relevant materials. The costs for any unclaimed reserved materials shall be charged according to the valid price list.
Article 28
Users and members may borrow materials in the collection on Slovenia and the collection of periodicals, as well as manuals and other reference materials, only for use in the reading room of the Library. Users and members must return such materials to the librarian who loaned it to them.
Article 29
At the written request of a member (a filled out special form), the Library may obtain materials it does not possess from other libraries. As a rule, the Library uses the inter-library loan system only for professional literature. Materials from other libraries may only be used in the reading room. The source library’s loan periods and price lists apply to such materials. The costs of inter-library loans shall be covered by the members.
Article 30
Users and members may use the reading room and other user sites in the Library to read periodicals, study, borrow and use Library materials or access the Library catalogue, the common catalogue or the Internet. Before using any user sites (the reading room or computers), members must identify themselves with their membership cards and leave them at the counter while they are using the user site. Non-members must identify themselves with a valid identity document containing a photograph.
Article 31
Each member or user may use the Library computers for a maximum of one hour a day or half an hour a day if there is a queue. When using computers, users must obey the written instructions that can be found next to the computers and the librarians’ instructions. Using your own notebook computer to access the Internet is allowed in the Library’s study reading room.
Article 32
Publicly accessible Library computers are intended chiefly for accessing the Library’s local and common catalogues, the Internet (public authority services and electronic business services), e-mail, material printouts and saving data to appropriate media. Computers may not be used for the following:
- viewing, creating, sending and publishing offensive or adult content;
- mass sending of e-mail (spam);
- using the Internet for commercial purposes;
- destroying or modifying other users’ data;
- playing computer games;
- using illegal software;
- using programs and processes the consequence or aim of which is to harm the integrity or stable operation of the computer and the computer system or network.
Article 33
The Library shall only copy Library-owned materials. Copying is not allowed when this would harm the material or if the material does not allow copying under the Copyright and Related Rights Act. Copying can be ordered from a library employee until one hour before closing time.
Article 34
In order to protect Library materials, a sound alarm security system is in place. In the event the alarm is activated, the Library visitors are required to cooperate with the Library employees to remedy the cause for the alarm’s activation.
VI. WORKING LANGUAGE
Article 35
Slovenian is the working language.
VII. SERVICE PRICE LIST
Article 36
The Library shall determine the service price list in an annex to these Rules. The price list for the following year must be adopted by the Library Council by the end of the current year.
VIII. FINAL PROVISIONS
Article 37
When applying for membership, new members must be informed of these Rules by the librarians. Members shall be deemed informed when these Rules are available for viewing on the information board along with the price list.
Article 38
These Rules are valid from 11 December 2006 onwards. On this date, all previous Library internal regulations that are in any way conflicting with the provisions of these Rules shall become invalid.
